These Terms and Conditions set out the basis on which Rubbish Removal Uxbridge provides waste collection and related services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions, the following expressions have the meanings set out below.
Company means Rubbish Removal Uxbridge, the provider of waste collection and rubbish removal services.
Customer means any individual, business, or organisation that requests or receives services from the Company.
Services means any waste collection, rubbish removal, clearance, or related services provided by the Company.
Waste means any items, materials, rubbish, refuse, junk, or other goods to be collected and removed by the Company during the provision of the Services.
Contract means the agreement between the Company and the Customer for the provision of the Services in accordance with these Terms and Conditions.
The Company provides rubbish removal, waste collection, and related clearance services for domestic households, commercial premises, and other sites. The exact scope of the Services will be confirmed at the time of booking based on information supplied by the Customer.
The Company may provide one-off clearances, regular collections, bulky waste removal, and other associated services. The Customer is responsible for ensuring that the Services requested are appropriate for their needs and site conditions.
3.1 Booking a service
Customers may request a booking by telephone, email, or online enquiry. When making a booking, the Customer must provide accurate and complete information about the type and approximate volume of waste, access conditions, collection address, contact details, and any relevant restrictions such as parking or building access rules.
3.2 Estimates and quotes
Any price given prior to attendance is based on the Customer's description of the Waste and access conditions and is an estimate only. The final price may differ if the actual Waste volume, type, or access conditions are materially different from those described at the time of booking.
3.3 Acceptance of booking
A Contract is formed only when the Company confirms the booking by telephone, email, message, or other written confirmation, or when the Customer accepts a quote and an appointment is agreed. The Company reserves the right to refuse or cancel any booking at its absolute discretion.
3.4 Access requirements
The Customer must ensure that the Company has safe, reasonable, and lawful access to the property and Waste at the agreed time. This includes arranging any necessary permissions, parking, security clearances, or keys or codes. If the Company cannot access the Waste due to inadequate arrangements by the Customer, this may be treated as a late cancellation and charges may apply.
4.1 Acceptable waste types
The Company collects most non-hazardous household and commercial waste, including general rubbish, bulky items, furniture, white goods that have been safely disconnected, garden waste, and non-hazardous construction debris. Acceptance of specific items is at the Company's discretion and may be subject to additional charges or conditions.
4.2 Prohibited and hazardous waste
The Company does not ordinarily collect hazardous or prohibited Waste, which may include but is not limited to asbestos, chemicals, solvents, oils, gas cylinders, clinical or medical waste, sharp materials such as used needles, pressurised containers, or any other substances classified as hazardous under applicable law.
If such Waste is discovered during the collection, the Company may refuse to remove it, adjust the quote, or terminate the job. The Customer may still be liable for any attendance or partial service charges incurred.
4.3 Legal compliance
The Company will handle, transport, and dispose of Waste in accordance with applicable UK waste management and environmental regulations. Where required, the Company will ensure that Waste is transferred only to appropriately licensed or permitted facilities.
4.4 Customer obligations regarding waste
The Customer confirms that they have the legal right to dispose of the Waste and that it is not stolen, unlawfully obtained, or subject to any third-party retention or ownership rights. The Customer must segregate any obvious hazardous or prohibited items and notify the Company of any concerns in advance.
5.1 Pricing structure
Prices are generally based on the type and estimated volume of Waste, labour involved, access conditions, and any additional services requested such as heavy lifting, dismantling, or extended loading times. Prices may also reflect costs associated with lawful disposal and recycling in the service area.
5.2 Confirmation of charges on site
Upon arrival, the Company will assess the Waste and confirm the final price with the Customer before commencing work. If the Customer does not agree to the revised price where applicable, the Company may cancel the service. The Customer may be charged a call-out or attendance fee if applicable and previously notified.
5.3 Payment methods
Unless otherwise agreed in writing, payment is due on completion of the Services on the day of collection. The Company may accept payment by cash, card, bank transfer, or other methods notified to the Customer from time to time. For business customers, the Company may at its discretion agree invoice terms subject to satisfactory credit arrangements.
5.4 Late or non-payment
If payment is not made when due, the Company reserves the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing payment, including legal and debt recovery costs. The Company may suspend or cancel future Services until outstanding sums are settled.
6.1 Customer cancellations
The Customer may cancel or reschedule a booking by giving the Company reasonable advance notice. Where the Customer cancels with at least 24 hours notice prior to the scheduled attendance time, no cancellation fee will normally be charged unless specific costs have been incurred by the Company for that booking.
6.2 Late cancellations and missed appointments
Where the Customer cancels with less than 24 hours notice, or where the Company attends the site but is unable to carry out the Services due to reasons within the Customer's control, the Company may charge a cancellation or call-out fee to cover costs such as travel and lost labour time.
6.3 Company cancellations or delays
The Company may need to cancel or reschedule a booking due to factors such as vehicle breakdown, staff availability, severe weather, safety concerns, or other circumstances beyond its reasonable control. In such cases, the Company will aim to notify the Customer as soon as practicable and offer an alternative appointment. The Company will not be liable for any indirect loss arising from such cancellation or delay.
6.4 Amendments to bookings
If the Customer wishes to change the date, time, or scope of the Services, they must contact the Company as early as possible. The Company will use reasonable efforts to accommodate changes but cannot guarantee availability. Changes to the scope of work may result in a revised price.
7.1 Preparation of waste
The Customer is responsible for ensuring that Waste is reasonably accessible and not contaminated with dangerous items. Where possible, Waste should be grouped together to enable efficient loading. Any dismantling of large items should be done safely and in accordance with relevant building and safety rules.
7.2 Safety and access
The Customer must provide a safe working environment and inform the Company of any risks, such as unstable structures, loose flooring, or other hazards. The Company reserves the right to refuse to carry out any work it considers unsafe or unlawful.
7.3 Presence on site
An authorised person should normally be present at the premises during the collection to grant access, confirm the Waste to be removed, authorise any additional charges, and make payment upon completion. If no one is present, the Customer accepts that the Company's assessment of the Waste and Services will be final and binding for pricing purposes.
8.1 Provision of services
The Company will provide the Services with reasonable care and skill and in accordance with applicable laws and waste regulations. The Company will make reasonable efforts to attend at the agreed time but cannot guarantee specific arrival times.
8.2 Staff conduct
The Company will ensure that its staff act in a professional manner and respect the Customer's property. Staff are not permitted to accept cash payments without issuing a receipt where one is requested or required.
8.3 Environmental responsibility
The Company will seek to dispose of Waste in a responsible manner, prioritising reuse and recycling where viable and lawful within the service area, subject to the nature of the Waste and the facilities available.
9.1 Damage to property
The Company will take reasonable care to avoid damage while carrying out the Services. However, the Company will not be liable for pre-existing damage, latent defects, or for damage resulting from inadequate or defective structures, fixtures, or access routes at the premises.
If damage is caused by the negligence of the Company while performing the Services, the Customer must notify the Company in writing as soon as reasonably practicable and in any event within 7 days of becoming aware of the damage, providing photographs and a description of the incident.
9.2 Exclusions of liability
To the maximum extent permitted by law, the Company will not be liable for any indirect, consequential, or economic losses, including loss of profit, business interruption, loss of data, or reputational damage arising out of or in connection with the Services or these Terms and Conditions.
9.3 Monetary cap
Subject to any rights the Customer may have under consumer law and save in respect of death or personal injury caused by negligence or for fraud, the Company's total liability to the Customer arising under or in connection with the Contract shall not exceed the total price paid or payable for the specific Services giving rise to the claim.
9.4 Items removed in error
The Customer is responsible for ensuring that only items intended for disposal are presented as Waste. The Company accepts no liability for items removed in error where they were reasonably presented as Waste or were mixed with Waste. If the Customer believes valuable items have been removed, they must contact the Company promptly. Recovery may not be possible once Waste has been processed or disposed of.
The Company will maintain appropriate public liability and, where applicable, employer's liability insurance in connection with the provision of the Services. Evidence of insurance can be provided upon reasonable request.
If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue. The Company will investigate complaints in good faith and will endeavour to respond promptly with a proposed resolution where appropriate.
The Company will collect and process certain personal data from Customers, such as contact details, addresses, and payment information, for the purposes of providing the Services, administering bookings, and managing accounts. The Company will handle personal data in accordance with applicable data protection legislation and will take reasonable steps to keep such data secure.
The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the booking will apply to the relevant Contract. Customers are advised to review the current Terms and Conditions before making a new booking.
These Terms and Conditions and any Contract between the Company and the Customer shall be governed by and construed in accordance with the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, their subject matter, or formation.
15.1 Severability
If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
15.2 Entire agreement
These Terms and Conditions, together with any written quotation or confirmation issued by the Company, constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior discussions, correspondence, or understandings.
15.3 Assignment
The Customer may not assign, transfer, or subcontract any of their rights or obligations under the Contract without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where this does not materially reduce the level of service provided to the Customer.
15.4 No waiver
Failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall not constitute a waiver of that or any other right or remedy.
